Maine Paid Family and Medical Leave
State Plan Details
In 2023, Governor Mills signed a historic budget that includes the creation of a paid family and medical leave program, making Maine the 13th state to establish one. Maine’s Paid Family and Medical Leave Program is established in Title 26 § 850-A through § 850-R. Click here to view the finalized rule. Beginning in 2026, eligible workers in the private and public sector will have up to 12 weeks of paid time off available.
What qualifying events could a worker use leave for?
- a family member with a serious health condition,
- to bond with a child after birth, fostering or adoption
- to care for their own medical needs
- to deal with the transition of a family member’s impending military deployment
- to stay safe after abuse or violence
Private Plan Rules
An employer may request to substitute a substantially equivalent private plan pursuant to 26 M.R.S. § 850-H. The employer must identify when the proposed substitute plan is a) an approved fully-insured private plan.
Applications for substitution may be made after January 1, 2026, but an exemption
may not be effective prior to April 1, 2026. Applications for substitution must be
submitted on a form provided by the Department. Applications for substitution may
be accepted on a rolling basis.
An approved substitution shall take effect on the first day of the first quarter following approval of the application. The employer is responsible for premiums provided under the Act and this rule until the effective date of substitution.
